Obiettivo di questo saggio è tracciare le relazioni che legano il recente “collasso ambientale” in Brasile alle torsioni autoritarie del governo Bolsonaro. Il presente lavoro si prefigge, pertanto, da una parte di ricostruire le trasformazioni normative e costituzionali in materia ambientale, dall’altra di rintracciare gli strumenti processuali utili a garantire l’effettività dei diritti. Ciò è importante al fine di porre le premesse idonee a dichiarare in Brasile, attraverso l’ADPF, un nuovo e generale «estado de cosas inconstitucional» in materia ambientale.

The aim of this essay is to trace the relationships that link the recent “environmental collapse” in Brazil to the authoritarian twists and twists of the Bolsonaro government. The aim of this work is, therefore, on the one hand, to reconstruct the legislative and constitutional changes in environmental matters, on the other hand, to trace the procedural instruments necessary to guarantee the effectiveness of the rights. This is important in order to lay the conditions suitable for declaring in Brazil, through the ADPF, a new and general “estado de cosas inconstitucional” in environmental matters.
