Abstract

Über Gegenwart und Zukunft der Preußischen Verfassung is the work that Constantin Frantz, a philosopher as well as a sharp analyst of political and legal phenomena, wrote in 1846, a period that Reinhardt Koselleck called the “Sattelzeit”: the time from the late 1700s to the first half of the 19th century, crucial for the formation of political categories that are still relevant today. Constantin Frantz examines the transformation between old and new by putting forward a constitutional proposal through his critique of the principles of liberal democracy and political romanticism. This article looks at that work by reconstructing the historical-political context and conceptual frameworks, highlighting the continued relevance of the author’s theoretical reflections in relation to the political-legal changes affecting today’s reality of Europe.
