Il principio ispiratore della risposta alla crisi innescata dal coronavirus SARS-CoV-2 parrebbe da rinvenire in una sorta di “tirannia” del diritto alla salute. Eppure, guardando al diritto oggettivo, questa pretesa “tirannia” del diritto alla salute non persuade, perché non appare convincente l’idea che l’ordinamento stia rispondendo con la logica dei diritti. La controffensiva al virus, difatti, sembra strutturarsi a partire dalla logica dei doveri, come dimostrerebbero anzitutto le dinamiche interne all’art. 32 Cost. I doveri costituzionali, d’altronde, per come positivizzati nella Costituzione italiana, svolgono una funzione integrativa, assicurando allo stesso tempo la protezione della libertà individuale. La pandemia in corso, quindi, ha reso più chiaro che il sapiente equilibrio tra autorità e libertà consacrato dal Costituente investe sul rafforzamento del principio solidaristico nell’affrontare le emergenze per poi creare le condizioni nel post-emergenza per far “rifiorire” i diritti.

The inspiring principle of the legal response to the crisis triggered by the SARS-CoV-2 coronavirus seems to be a sort of “tyranny” of the right to health. Nevertheless, looking at objective law, this alleged “tyranny” of the right to health is not convincing, because the idea that the system is responding with the logic of rights is not convincing. The counteroffensive to the virus, in fact, seems to be structured starting from the logic of duties, as the internal dynamics of Article 32 of the Italian Constitution would demonstrate. Constitutional duties, in general, perform an integrative function and at the same time guarantee the protection of individual freedom thanks to how they are positivized by the Italian Constitution. The ongoing pandemic, therefore, has made it more evident that the wise balance between authority and freedom consecrated by the Constituent Assembly invests in strengthening the principle of solidarity in dealing with emergencies in order to create the conditions in the post-emergency to “flourish” the rights again.
